1. Agreement to Terms
By accessing or using PingRoot ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
The Service is operated by TENbase Labs ("Company", "we", "us", or "our").
2. Description of Service
PingRoot is an API monitoring platform that allows you to:
- Monitor HTTP/HTTPS endpoints
- Track uptime, latency, and status codes
- View detailed request logs
- Receive notifications when monitored endpoints go down (where applicable)
The Service is provided on a subscription basis with both free and paid tiers.
3. Eligibility
You must be at least 18 years old to use this Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
4. Account Registration
4.1 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password
- Accept responsibility for all activities under your account
4.2 Account Security
You are responsible for safeguarding your account credentials. You agree to notify us immediately of any unauthorized access or use of your account.
We reserve the right to terminate accounts that have been inactive for more than 12 months.
5. Subscription Plans
5.1 Free Plan
The Free Plan includes:
- Up to 5 monitors
- 5-minute minimum check intervals
- 7 days of log retention
- No credit card required
5.2 Pro Plan
The Pro Plan ($9 USD/month) includes:
- Unlimited monitors
- 1-minute minimum check intervals
- 30 days of log retention
- Priority email alerts
- Priority support
5.3 Billing
- Subscriptions are billed monthly in advance
- Payment is processed through Stripe
- All fees are non-refundable except as required by law
- You authorize us to charge your payment method on a recurring basis
- We reserve the right to change pricing with 30 days' notice
5.4 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.
6. Acceptable Use Policy
You agree NOT to:
- Use the Service to monitor endpoints you do not own or have permission to monitor
- Use the Service to perform denial-of-service (DoS) attacks or similar harmful activities
- Attempt to circumvent plan limits or rate limits
- Use the Service for any illegal purpose
- Reverse engineer, decompile, or attempt to extract source code
- Resell, redistribute, or provide access to the Service to third parties
- Monitor private networks or internal endpoints (SSRF attacks)
- Use the Service to store or transmit malicious code
- Interfere with or disrupt the Service or servers
Violation of this policy may result in immediate account suspension or termination.
7. Service Level & Availability
7.1 Uptime
We strive to maintain 99.9% uptime for the Service, but we do not guarantee uninterrupted access. The Service is provided "as is" without warranties.
7.2 Scheduled Maintenance
We may perform scheduled maintenance with advance notice when possible. We are not liable for any downtime during maintenance windows.
7.3 Data Retention
- Free Plan: Logs retained for 7 days
- Pro Plan: Logs retained for 30 days
After the retention period, logs are automatically deleted and cannot be recovered.
8. Monitoring Limits & Fair Use
8.1 Rate Limits
To ensure fair usage and service stability:
- Free Plan: Maximum 5 monitors, 5-minute minimum intervals
- Pro Plan: Unlimited monitors, 1-minute minimum intervals
8.2 Fair Use Policy
We reserve the right to throttle or suspend accounts that:
- Create an excessive number of monitors (>10,000)
- Generate excessive API load
- Abuse the Service in a manner that impacts other users
We will notify you before taking action when possible.
9. Intellectual Property
9.1 Service Ownership
The Service, including all software, designs, text, graphics, and other content, is owned by TENbase Labs and protected by copyright, trademark, and other intellectual property laws.
9.2 Your Data
You retain all rights to the data you input into the Service (endpoint URLs, headers, etc.). By using the Service, you grant us a license to use this data solely to provide the Service to you.
9.3 Feedback
If you provide feedback or suggestions about the Service, we may use that feedback without any obligation to you.
10. Privacy & Data Protection
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We comply with GDPR and other applicable data protection laws. See our Privacy Policy for details on how we collect, use, and protect your data.
11. Third-Party Services
The Service integrates with third-party services (e.g., Stripe for payments, Supabase for hosting). Your use of these services is subject to their respective terms and privacy policies.
We are not responsible for the actions, content, or privacy practices of third-party services.
12. Disclaimers
12.1 No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12.2 No Guarantee of Accuracy
While we strive for accuracy, we do not guarantee that monitoring data (uptime, latency, logs) is 100% accurate or complete.
12.3 No Monitoring Guarantee
We do not guarantee that:
- Monitors will run at exact intervals
- Notifications will be delivered instantly
- The Service will detect all downtime events
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for damages caused by third-party services, network issues, or force majeure events
14. Indemnification
You agree to indemnify and hold harmless TENbase Labs, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
15. Termination
15.1 Termination by You
You may terminate your account at any time by:
- Canceling your subscription in account settings
- Contacting support at support@pingroot.com
15.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms
- You engage in fraudulent activity
- Your account poses a security risk
- Required by law
15.3 Effect of Termination
Upon termination:
- Your access to the Service will be revoked
- Your data will be deleted after 30 days (unless required by law to retain)
- You remain responsible for any outstanding fees
16. Changes to Terms
We may modify these Terms at any time. Changes will be effective immediately upon posting to the Service.
Material changes will be notified via:
- Email to your registered email address
- In-app notification
Continued use of the Service after changes constitutes acceptance of the new Terms.
17. Governing Law & Dispute Resolution
17.1 Governing Law
These Terms are governed by the laws of France, without regard to conflict of law principles.
17.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through:
- Good faith negotiation between parties
- Mediation (if negotiation fails)
- Courts of competent jurisdiction in France
18. Miscellaneous
18.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TENbase Labs regarding the Service.
18.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
18.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
18.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
18.5 Force Majeure
We are not liable for any failure or delay in performance due to events beyond our reasonable control (e.g., natural disasters, wars, internet outages).

20. Language
These Terms are provided in English. In case of any conflict between the English version and a translated version, the English version shall prevail.
By using PingRoot, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
