Terms of Service

These Terms of Service ("Terms") govern your access to and use of PingRoot, operated by LB FRAME, a SASU registered in Salon de Provence, France ("we", "us", or "our"). By creating an account or using our services, you agree to be bound by these Terms.
1. Services
PingRoot provides real-time API and website monitoring services. The specific features, monitoring intervals, and data retention periods vary based on the subscription plan selected (Free, Pro, Team, or Enterprise). We reserve the right to modify, suspend, or discontinue any part of the service at our discretion.
2. Subscription Plans and Billing
- Plans: Service fees are billed in advance on a monthly or annual basis.
- Payments: All financial transactions are processed securely via Stripe.
- No Commitment: Subscriptions are non-binding. You may cancel your plan at any time.
- Downgrades: If you choose to downgrade your plan, the change will take effect at the end of your current billing cycle. No immediate refunds are issued for downgrades.
- Taxes: VAT will be applied to invoices based on your geographic location and tax status (B2B vs. B2C) in compliance with French and European Union tax regulations.
3. Right of Withdrawal and Refunds
In accordance with European Union consumer protection laws, individual users have a 14-day right of withdrawal.
- If you exercise this right, LB FRAME will provide a refund prorated according to the service consumption up to the date of cancellation.
4. Limitation of Liability
- "As Is" Basis: PingRoot is provided as an assistant tool. We do not guarantee 100% uptime, nor do we guarantee that all downtime events will be detected or that notifications will always be successfully delivered.
- Exclusion of Damages: To the maximum extent permitted by law, LB FRAME shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or business reputation resulting from service interruptions or notification failures.
- SLA: Service Level Agreements (SLA) and uptime guarantees are strictly reserved for the Enterprise plan and are subject to a separate signed contract.
5. Acceptable Use
You agree not to use PingRoot for:
- Unauthorized vulnerability scanning or penetration testing of third-party infrastructure.
- Orchestrating Distributed Denial of Service (DDoS) attacks.
- Attempting to bypass Server-Side Request Forgery (SSRF) protections.
6. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with French Law. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Salon de Provence, France.
